Is Medical Marijuana Legal in Nebraska?

The constitutional amendment means that lawmakers are required to come up with a plan of action to allow qualified Nebraska residents legal access to therapeutic forms of cannabis that will treat their conditions. The less good news is that a functional program has not yet been implemented in the state. 

 

Regardless, medical marijuana in Nebraska is not far off. Lawmakers are in the process of working out the details of the brand-new program that the Nebraska State Department of Health will be regulating.

 

By August 2021, you should be able to access a doctor to get your Nebraska marijuana card and start getting the natural relief you deserve. This is very exciting news considering medical marijuana has been legalized all across the country and now the wait is finally coming to an end for residents of Nebraska!

How to Qualify For A Medical Marijuana Card in Nebraska?

Once medical marijuana is legalized in , you must fulfill the following: 

  • Be at least 18 years of age or older

    • Patients under 18 years of age must have parental consent
       

  • Have a current diagnosis of a debilitating medical condition (see list below)
     

  • Hold a written certification from a doctor 
     

  • Be a Nebraska resident with proof of residency (valid Nebraska drivers license or state ID card)

 

What Conditions Are Approved For Medical Marijuana Treatment in Nebraska?

The new constitutional amendment in Nebraska states that having a diagnosis of the following conditions will qualify patients in the state for access to medical marijuana. If you are diagnosed with one of these conditions, you need to get a Nebraska marijuana card from a doctor who can recommend it. Once you do, you will be free to make purchases at dispensaries that sell safe, effective, medical-grade marijuana.

  • Epilepsy or other seizures

  • Parkinson’s disease

  • Huntington’s disease

  • Muscular dystrophy

  • Multiple sclerosis

  • Cachexia (weakness and wasting due to chronic illness)

  • Post-traumatic stress disorder

  • HIV+

  • AIDS

  • Chronic or debilitating pain

  • Amyotrophic lateral sclerosis, or ALS

  • Glaucoma

  • Agitation from dementia

  • Crohn’s disease 

  • Ulcerative colitis

  • Sickle-cell anemia

  • Autism with aggressive or self-injurious behaviors 

  • Pain refractory to appropriate opioid management

  • Spinal cord disease or severe injury

  • Intractable nausea

  • Severe muscle spasticity 

  • Other conditions where a physician believes the benefits of marijuana would outweigh risks
