On June 26, the Nebraska Medical Marijuana Commission voted unanimously to approve emergency regulations for the state’s medical marijuana program. These rules are designed to get the program up and running quickly while full, permanent regulations are developed.


The emergency rules cover how dispensaries and producers will operate and how patients can qualify and register for medical marijuana. While the regulations aim to balance patient access and public safety, they do include some limitations.


One of the restrictions in the emergency rules is a ban on smokable marijuana flower. Patients will not be allowed to purchase or use whole flower products; instead, the program will allow for other forms, such as oils, tinctures, capsules, or topical products. Officials cited health concerns and regulatory challenges as reasons for the ban.


Legal Challenges Dismissed

The progress of Nebraska’s medical marijuana program was threatened earlier this year by a series of lawsuits challenging the law. Opponents argued that the voter-approved initiative conflicted with federal law and should be overturned.


However, Nebraska courts have now dismissed those challenges.


In late June, a federal judge rejected a lawsuit claiming that the state law was preempted by federal drug laws, ruling that the law can move forward. Similarly, another lawsuit that sought to overturn the medical marijuana law on constitutional grounds was dismissed by a state judge.


These court decisions clear a major hurdle and ensure that Nebraska’s medical marijuana program can continue to move forward as planned.
