Patients will not be allowed to purchase or use whole flower products; instead, the program will allow for other forms, such as oils, tinctures, capsules, or topical products. Officials cited health concerns and regulatory challenges as reasons for the ban.

Legal Challenges Dismissed

The progress of Nebraska’s medical marijuana program was threatened earlier this year by a series of lawsuits challenging the law. Opponents argued that the voter-approved initiative conflicted with federal law and should be overturned.

However, Nebraska courts have now dismissed those challenges.

In late June, a federal judge rejected a lawsuit claiming that the state law was preempted by federal drug laws, ruling that the law can move forward. Similarly, another lawsuit that sought to overturn the medical marijuana law on constitutional grounds was dismissed by a state judge.
