The Nebraska Medical Marijuana Commission met this week to continue building the framework for the new program. While the meeting showed some encouraging steps forward, it also highlighted ongoing challenges, including setting product rules and securing the necessary funding to make the program work. With the October licensing deadline quickly approaching, the commission is working to ensure everything is in place for the program’s rollout.

Public Feedback, Product Rules, and Funding Challenges

Many Nebraskans came to share their thoughts during the meeting, with a big focus on what marijuana products should be allowed. Some patients and advocates spoke about the benefits of smoking marijuana for fast symptom relief, especially for those living with chronic pain or PTSD. Others asked the commission to allow flavored products, explaining that these can make treatment more pleasant and easier to tolerate.

Without a dedicated budget or the ability to collect application fees, the group has been relying on the Nebraska Liquor Control Commission for administrative support and even basic expenses. This has made it harder to move forward at the pace many patients are hoping for.

Despite funding challenges, the commission is pushing forward with plans to launch Nebraska’s medical marijuana program. A seed-to-sale tracking system is expected to be required, though license holders may have to cover the costs directly due to limited state funding.

Confusion has also surrounded the release of new draft regulations. Advocates were caught off guard when two competing versions appeared, one 46 pages and another 47-page “highlighted” version, just hours before a public hearing. The highlighted draft included major changes such as raising the dispensary cap from 12 to 21, permitting vaping products, and allowing vertical licensing. Many stakeholders voiced support for these updates, but the commission largely set them aside, with only one commissioner speaking in favor.

The clock is ticking, however. Current emergency rules expire at the end of September, and by October 1, 2025, the commission must begin accepting applications for cultivators, manufacturers, transporters, and dispensaries. Updated regulations are expected soon, with licensing to roll out in phases starting with cultivation.

Transparency and Trust

Some advocates have raised concerns about the commission’s transparency, pointing out that research used in the meeting wasn’t shared with the public beforehand. Having open communication and involving patients in the process will be key to creating a program that works for everyone.
