Nebraska Patients Are Closer to Accessing Medical Marijuana: Recent Updates

In a landmark moment for healthcare access in the Cornhusker State, Nebraskans overwhelmingly voted to legalize medical marijuana in November 2024. Two separate ballot initiatives passed by wide margins, 71% of voters approved the legalization of medical marijuana, while 68% supported a companion measure to regulate its use and distribution.


This marks a major shift in state policy, especially for thousands of residents suffering from chronic conditions who previously had to go without or risk traveling out of state for relief. Patients will still need to wait until Nebraska’s medical marijuana program officially launches before they can legally access products or obtain a medical marijuana card.


Legislative Developments

Since the election, Nebraska lawmakers have worked to build out the framework of the newly approved medical marijuana system. Most notably, the General Affairs Committee passed amendments to LB 677, the key bill that outlines how marijuana will be distributed to patients.


But the version that passed is different from what voters expected. The amended legislation:

  • Prohibits smoking marijuana flower, even for qualified patients

  • Reduces the possession limit from 5 ounces to 2 ounces

  • Narrows the list of qualifying conditions

  • Restricts which healthcare practitioners can issue authorizations


These restrictions have drawn criticism, especially since none of them were part of the original voter-approved initiatives. Advocates argue that the legislature is watering down the law and limiting access for patients who desperately need alternative treatment options.


Legal Challenges Still Looming

Despite strong voter support, the path to implementation isn’t entirely clear yet. Nebraska’s Attorney General filed a lawsuit attempting to nullify the election results, citing procedural concerns and claiming federal law should override state efforts.


Although a district court judge rejected the AG’s arguments, the case is currently on appeal to the Nebraska Supreme Court. In addition, a separate lawsuit filed by a former state senator also seeks to block the law based on similar legal grounds.


These legal battles could delay parts of the rollout, but so far, the momentum remains on the side of the patients. Advocacy groups like Nebraskans for Medical Marijuana continue to fight to preserve what voters overwhelmingly approved.


What to Expect From Nebraska’s Medical Marijuana Program

Once fully implemented, Nebraska’s medical marijuana program will include a patient registration system, licensed dispensaries, and guidelines for safe use. Patients will need a certification from an authorized healthcare provider in order to qualify for a state-issued medical marijuana card - that’s where we will come in!

  • No smoking of marijuana flower will be allowed 

  • Possession will be capped at 2 ounces

  • Only patients with approved medical conditions will qualify

  • Medical marijuana cards will need to be renewed annually

  • The Department of Health and Human Services will oversee regulation and compliance


More guidance will become available as the program moves closer to launch. Patients and caregivers are encouraged to follow state announcements and advocacy group updates to stay informed.
