Nebraska’s Medical Marijuana Program: Recent Updates

In late June 2025, and again with revisions on September 2 of this year, the Nebraska Medical Marijuana Commission approved a package of emergency rules that could reshape the state’s voter-approved medical marijuana program. 


The proposals include restrictions on product types, licensing, and patient purchases, but these rules are not yet final and may still be adjusted through public comment, legal challenges, or legislative action.  Either way, the program will still provide patients with much-needed access to medical marijuana once it launches.


Here’s a detailed look at the program updates, their significance, and what they mean for patients.


Proposed Product Restrictions

One of the most discussed changes in the emergency rules is the proposed ban on certain product types. Dispensaries would not be allowed to sell raw marijuana flower, shake, trim, or pre-rolls. Shake and trim are byproducts of marijuana flower that are sometimes lower-cost alternatives patients rely on. Edibles and products intended for smoking or combustion would also be restricted, along with some forms of vaping.


If these rules are adopted, patients would primarily have access to tinctures, oils, capsules, and a few select alternatives. While some patients prefer inhalable or edible products for faster or longer-lasting relief, the program will still provide several effective options for treatment once dispensaries open.


License and Production Caps

The emergency rules also propose limiting the number of businesses in the program: roughly four cultivators and twelve dispensaries statewide. Each cultivator would be capped at about 1,250 flowering plants, which could create supply challenges if demand exceeds production.


Even if these limits are finalized, obtaining a medical marijuana card will allow patients to access safe, regulated products tailored to their medical needs. Planning ahead by getting a card ensures patients can take advantage of the program as soon as dispensaries open.


Patient Purchase and THC Limits

Patients and caregivers could face restrictions on how much marijuana they can obtain. Proposed rules include up to five ounces in a 30-day period, with limits on total delta-9 THC over 90 days.


While these limits may affect some dosing strategies, the program will still provide beneficial legal access to medical marijuana, helping patients manage symptoms, improving quality of life, and providing relief for conditions that can otherwise be difficult to treat.

These emergency rules show that Nebraska’s program will be carefully regulated, potentially limiting certain products and establishing strict licensing and purchase caps. For patients, this could mean fewer choices and possible supply constraints. However, it’s important to remember that these rules are not yet official and could change before the program fully launches.


Regardless of the final rules, having a medical marijuana card will be essential for patients to access legal, physician-recommended cannabis once dispensaries open, offering a versatile option for managing pain, inflammation, neurological conditions, and other qualifying health issues.
